Public–Private Interactions in Privacy Governance

This paper addresses the possible roles of private actors when privacy paradigms are in flux. If traditional “informed consent”-based government-dominated approaches ill-suited to big data ecosystem, can governance fill gap created by state regulation? In reality, how is public–private partnership being implemented protection frameworks? uses cases from APEC’s Cross-Border Privacy Rules (CBPR) and EU’s General Data Protection Regulation (GDPR) as models for exploration. The analysis this demonstrates fluidity interactions across public realms. Self-regulation regulation opposing ends a regulatory continuum, with CBPR-type “collaboration” GDPR-type “coordination” falling somewhere middle. author concludes that there an evident between actors’ potential governing functions their current regimes.
